Terms and Conditions

These are the terms and conditions ('terms') for use of the website ('site') of Marketing Leeds ('we/us/our'). Contact details appear at the end of these terms.

1. Use of the Site
All use of the website is strictly on the terms and conditions below.

If you do not agree to these terms, please cease use of the site immediately.

You may print and keep a copy of these terms. They are a legal agreement between us and can only be modified with our consent. We reserve the right to change the terms at our discretion by changing them on the site.

We provide a service allowing individuals to access and browse information produced by Marketing Leeds and their partners and posted by certain third parties.

If you use the site and wish us to provide you with the services on it ('services'), you agree to comply with the rules set out below and you have read and agree to abide by our Privacy Policy. In particular, you consent to the fact that a limited amount of information (your name and your email address) may be made available over the internet as part of the service.

We are concerned about the safety and privacy of all of our users, particularly children and young adults. For this reason, if you are under the age of 16, you may access and browse the site but you are only permitted to register your details with parental permission.

We may amend the rules at any time by posting the amended rules on the website. All amended rules will automatically apply once they are posted on our site. It is your responsibility to make sure that you are aware of any such amendments and you will be deemed to have accepted them if you access the website after they have been made.

If you access this website from outside the UK, no representation or warranty is made as to whether the information available in this website complies with the regulatory regimes of your country of access.

2. Use of the service
Please note that use of the website or the service for purposes which are not permitted by these terms are at your own risk. You will be liable to reimburse Marketing Leeds for any loss or damage which Marketing Leeds suffers as a result of such use. Use of this website is for your non-commercial and personal use only. You may NOT in any circumstances transmit, copy, display, reproduce, perform, modify, distribute, create derivative works, license, publish, transfer, or sell any products, services, software, source code or information obtained from or through this website including  text, graphics, logos, icons and images without express written permission from Marketing Leeds save for where specifically permitted within these terms.

You shall:
  • only use the website for lawful purposes and in a manner which does not infringe the rights of, restrict or inhibit anyone else's use of the website
  • use reasonable skill and care in using the website
  • refer any breach of these terms to the Marketing Leeds contact immediately
  • identify yourself in the appropriate manner and accurately when using the Marketing Leeds website

In the interests of all our users, Marketing Leeds will co-operate with investigations by any law enforcement or relevant authorities of suspected criminal activity or violation of systems or network.

3. Your obligations
In return for us allowing you to use the service, you agree: (a) to provide true, accurate, current and complete information about yourself, and (b) to maintain and promptly update the personal information and keep it true, accurate, current and complete.
If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your use of the service.
If either Marketing Leeds or you wish to terminate this agreement, this can be done by sending an e-mail (by us to your e-mail address and by you to enquiries@marketingleeds.com) or by post (by us to your usual address and by you to our address set out at the bottom of this page).

4. Our Liability
We provide information on this site free of any access charge and on the basis of no liability for the information given.

You hereby agree fully to indemnify, keep indemnified and hold us or any of our officers, employees, agents, sub-contractors and affiliated companies, harmless from and against any and all costs, claims, losses, damages or liability and expenses (including, but not limited to, legal fees) made by any third party in any jurisdiction due to or arising out of your use of the service, your connection to the website, your breach of the terms or any other breach by you of any third party rights.

We are a distributor (and not a publisher) of content supplied by third parties and users of the site. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or users, are those of the authors or distributors and not of us. We do not necessarily endorse nor are we responsible for the accuracy or reliability of any opinion, advice or statement made on the site.

5. Ownership and use of proprietary rights
All content (other than any content on the website provided by tourism establishments and third party providers), software and source code included or used on the website, including text, graphics, logos, icons, images (together, the 'content') and the arrangement and compilation of the content and any databases are the property of Marketing Leeds or its suppliers. All content is protected by United Kingdom and international intellectual property laws, including, copyright laws.

However, any text can be downloaded by our customers and citizens free of charge, to file or print without our permission. This is subject to the material being reproduced accurately, and not being re-used or re-published in any way. This permission does not extend to any material on our site, which belongs to someone else, for example where it is identified as being the copyright of someone else.
The visual identity and logo of Marketing Leeds and the ‘Leeds, Live it, Love it’ logo are trade marks.  You are not permitted to use or reproduce or allow anyone else to use or reproduce these trade marks for any reason, unless otherwise expressly stated within these terms.
Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trade mark, patent, design right or copyright of Marketing Leeds, or any other third party.

Any use of such intellectual property rights, software or source code, or any reproduction of the website content is strictly prohibited except where expressly allowed under these terms.
Any requests for permission to use the content in a manner otherwise than permitted by these terms should be addressed to the Marketing Leeds contact.

6. Accuracy of information
Marketing Leeds do our best to ensure all information on the site is accurate.

If you find any inaccurate information on the site, let us know, and we will correct it, where we agree, as soon as practicable.

You should independently verify any information before relying upon it.

We make no representations that information is accurate and up to date or complete and accept no liability for any loss or damage caused by inaccurate information. This site gives a large amount of data and there will inevitably be errors in it, particularly because dates and times of events change and cancellations occur. You are advised to check directly with the organisers of the event concerned before making any arrangements.

7. Third party providers
This website contains material, details of suppliers of goods and services and other advertising and sponsorship, which originates from third parties including The Press Association and Leeds City Council. We accept no liability in relation to such materials. We provide such materials for your convenience only and do not necessarily endorse the content of those, supplier details, advertisements and/or sponsorship. We are not in any way responsible for any transaction conducted between you and any third party featured on the website. Any transactions which you conduct with them is conducted at your own risk.
 
8. Third party links
We may provide hyperlinks to other internet sites. We are not responsible for the availability of such other sites and Marketing Leeds does not endorse, and is not responsible or liable for any content, products or other materials available on such other sites.

9. Virus protection
We make every effort to check and test the material on our site. However, it is always wise to run an anti-virus program on all material downloaded from the internet. Marketing Leeds cannot accept any responsibility or liability for any loss, disruption or damage to your data or to your computer system, which may occur as a result of using material from our site.

10. Barring from the site
We reserve the right to bar users from the site on a permanent or temporary basis at our discretion. Any such user shall be notified and must not then attempt to use the site under any other name or through any other user.

11. General
Notwithstanding the jurisdiction where you are based, English law shall apply to these terms and the privacy policy. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with our websites and these terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England.

You may not assign, sub-license or otherwise transfer any of your rights under these terms.

If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.

Nothing in these terms shall create any right or benefit for any third party under the Contracts (Rights of Third Parties) Act 1999 manner in which we perform this agreement.

Any formal legal notices should be sent to us at the address at the end of these terms by email confirmed by post.
